表达自由在中国宪法学内未能得到严肃的学术对待,原因即在于宪法学者经常基于舶来自西方的宪政模式或者自身的“偏见”经验来剪裁本土的宪政实践。本文提出了“跨省监督”这个概念去解释中国宪政体制内生长着的表达自由。首先,中国宪政体制内的“跨省”结构决定了表达自由发生的必然性,本文将区分四个前后相接的环节来建构这一跨省剧目的模型。在此基础上,本文将跨省监督置于中国宪政发展的复眼视角,指出它事实上体现了中国宪政体制的一种关键的无意识欠缺以及未来宪法发展的枢纽环节。文章论述所希望表达的学术态度是要基于本土宪法实践来重新发现被学者遗忘乃至否认的中国宪法。
Freedom of expression in the Chinese constitutional law failed to get a serious academic treatment, because the constitutional scholars often based on the constitutional pattern from the West or their own “bias ” experience to tailor the local constitutional practice. This paper proposes the concept of “provincial supervision” to explain the freedom of expression that is growing within the constitutional system of China. First of all, the “trans-provincial” structure in China’s constitutional government system determines the inevitability of freedom of expression. This article will distinguish the four links that come before and next to construct this inter-provincial model. On this basis, this paper puts the inter-provincial supervision in a multi-eye perspective of the development of constitutional government in China, pointing out that it actually reflects a key unconsciousness of China’s constitutional system and the pivotal link in the constitutional development in the future. The article discusses the academic attitude that it hopes to express is to rediscover the Chinese constitution forgotten or even denied by scholars based on the local constitutional practice.
