1 保健食品的现状 1995年10月30日,全国人大常委会第16次会议通过《中华人民共和国食品卫生法》并于公布之日起施行。食品卫生法第22条、第23条明确了保健食品的概念。从而,奠定了保健食品在中国的合法地位。1996年3月15日陈敏章部长根据食品卫生法的授权,签发《保健食品管理办法》,(以下简称办法)并于1996年6月1日起实施。《办法》第五条明确规定:凡声称具有保健功能的食品必须经卫生部审查确认,研制者应向所在地的省级卫生行政部门提出申请。经初审同意后,报卫生部审批。各级卫生行政部门不能超越卫生部而自行审批保健食品。
1 The current situation of health food On October 30, 1995, the 16th meeting of the Standing Committee of the National People’s Congress passed the “Food Sanitation Law of the People’s Republic of China” and came into effect on the promulgation date. Article 22 of the Food Sanitation Law clarifies the concept of health food. Thus, laid the health food in China’s legal status. On March 15, 1996, Minister Chen Minzhang issued the Measures for the Administration of Health Foods according to the authorization of the Food Sanitation Law (hereinafter referred to as the Measures) and implemented it on June 1, 1996. Article 5 of the Measures clearly stipulates that any food claiming to have health-care functions must be examined and confirmed by the Ministry of Health and the developer should apply to the provincial health administrative department at the locality. After the first trial agreed, reported to the Ministry of Health for approval. Health administrative departments at all levels can not go beyond the Ministry of Health and their own approval of health food products.
