不相抵触原则是我国地方立法中的一项重要的基本原则,但我国目前仍然存在着许多地方立法与中央立法抵触的情形,虽然已有许多学者对此进行过研究,但却无人针对恶法上位法的情形进行深度探索。本文主要就在恶法上位法的情形如何认定恶法以及如何解决恶法上位法的问题进行了综合分析。
