在深化改革,建立社会主义市场经济的新形势下,随着政府管理职能的转变及企业经营机制的转换,安全生产出现了滑坡,工伤事故时有发生。劳动安全监察工作难以开展,从而制约了经济的健康发展。究其原因,我们认为主要有这样几点: 一、法制不健全。在我国现阶段社会生活的各个领域中,都能体会到法制不健全这个问题。但在劳动安全监察工作中,矛盾尤为突出。主要表现有两个方面。一是,在事故处理过程中,尤其是涉及到对事故责任人的处理,个别领导的主观臆断代替法律规定。

Labor safety supervision is difficult to carry out, thus restricting the healthy economic development. The reason, we think the main points are: First, the legal system is not perfect. There are two main aspects. First, in the process of accident handling, especially concerning the handling of the persons responsible for the accident, the subjective assumptions of individual leaders replace the legal provisions.
