伴随着依法治国的脚步,历经半个世纪的风风雨雨,在经历了无数风波和国人的翘首企盼中,我国民商法律体系中一部重要的基础性法律——《物权法》终于浮出水面。《物权法》的颁布实施,使因物的归属和利用而产生的民事关系调整纳入完整的法律体系,对于完善我国物权法律制度,保障市场主体的平等法律地位和促进社会主义市场经济的健康发展将发挥巨大的作用。同时,《物权法》的颁布实施,也必将对以证明民事法律事实和调整民事法律关系为主要对象的公证制度带来重大的影响。如何依据《物权法》完善我国公证制度?如何按照《物权法》调整和规范公证工作?如何审视《物权法》后法律服务市场的格局变化?公证行业如何应对“物权法时代”的到来?是每一位公证业内人士必须面对和思考的问题,是摆在公证行业面前一项十分紧迫的任务。笔者在认真研读《物权法》和总结公证工作实际的基础上,略书拙见,与业内人士共同探究。

How to perfect the notarization system of our country according to the “Property Law”? How to adjust and standardize the notary work in accordance with the “Property Law”? How to examine the pattern change of the legal service market after the “Property Law”? How should the notary industry deal with the arrival of “Property Law Age”? Notarial professionals in the industry must face and think about issues that are placed in the notary industry before a very urgent task. On the basis of earnestly studying the “Property Law” and summarizing the actual work of notarization, the author clumsyly discussed it with others in the industry to explore together.
