随着当今国际投资活动的迅速发展,预防海外投资政治风险的海外投资保险法律制度已显得尤为重要。本文在综合考察美、日、德三国海外投资保险法律制度的基础上,运用比较法方法,对海外投资保险制度中的投资保险法律关系主体、保险范围、承保条件以及保险费、保险期、保险金等方面进行了较为详细的分析和论述,并就建立我国海外投资保险法律制度提出了一些设想。
With the rapid development of international investment activities today, the overseas investment insurance legal system for preventing political risks of overseas investment has become particularly important. On the basis of a comprehensive study on the legal system of overseas investment insurance in the United States, Japan and Germany, this paper applies the comparative method to analyze the subjects of the legal relationship of investment insurance in the overseas investment insurance system, the scope of insurance, the underwriting conditions and the insurance premiums, Gold and other aspects of a more detailed analysis and discussion, and set up our country’s overseas investment insurance legal system put forward some ideas.
