汉律是在秦律的基础上制定的,不过汉律在秦律的基础上并非全盘照搬,而是根据当时的时代背景和需要对秦律进行了一定的发展和改进,这种发展和改进我们从《二年律令》的盗律中可以明显看出来。
The law of Han was formulated on the basis of the law of the Qin Dynasty. However, the law of Han dynasty was not copied entirely on the basis of the law of the Qin Dynasty. Rather, the law of Qin dynasty was developed and improved according to the background and needs of the time. We can clearly see it from the steal of the “two year ordinance.”
