随着科学技术的进步,通过手机短信息群发和电子邮件的网络方式发布的强迫广告日益增多。由于目前我国对强迫广告监管法律体系的不完善,存在着内容违法虚假等诸多问题,强迫广告具有接受方式的强制性、骚扰性、被动性特点,其社会危害性也逐渐显现。本文建议将网络强迫广告纳入工商行政管理机关日常监管范围,提出了从加强网络广告经营者、运营商与广告内容的管理,加大行政执法力度,完善相关人员法律责任等方面入手完善对强迫广告进行监管和制裁。
With the advancement of science and technology, there has been an increasing number of forcible advertisements released through the internet through mobile short messages and e-mail. Due to the imperfect legal system of forced advertising supervision in our country, there are many problems such as illegal and fake contents, forced advertisement has the characteristics of compulsion, harassment and passivity of accepting mode, and the social harmfulness gradually appears. This article suggests that the network forced advertisement should be included in the daily supervision scope of the administrative department of industry and commerce, and put forward the measures to improve the enforcement of forced advertising from the aspect of strengthening the management of online advertising operators, operators and advertising contents, strengthening administrative law enforcement and perfecting the legal responsibilities of relevant personnel Regulatory and sanctions.
