由于空判、执行难、司法资源浪费等原因,我国立法和司法实践都把死亡赔偿金排除在刑附民案件赔偿范围之外,但是,附民诉讼的死亡赔偿金问题仍然饱受争议,针对死亡赔偿金提起的上诉请求仍占多数.空判问题和被害人权益保障的冲突使得死亡赔偿金的适用陷入两难境地,被害人国家补偿制度的引入有助于解决这一矛盾.
