概念教学是大学本科法学专业教育的基础性工作。按照熟悉→理解→运用的客观学习规律,结合法律概念的特性,相应的教学活动在上述阶段依次可以利用三种不同的教学方法:快速熟悉概念的还原法、理解概念本质的功能法、探求概念限度的比较法。三种方法依次侧重回答了法律概念“是什么”、“为什么”、以及“怎么用”的递进命题。各种方法不仅有助于学生充分理解法律概念,还能培养学生关注现实、注重法律运用的良好思维习惯。
Concept teaching is the basic work of undergraduate legal education. According to the law of objective learning from familiarity → understanding → application and the characteristics of legal concepts, the corresponding teaching activities can take advantage of three different teaching methods in turn at the above stages: quick familiarization with conceptual reduction, functional method with conceptual essence, exploration of concept Limitation of the law. In turn, the three methods focus on the progressive propositions of legal concepts such as “what,” “why,” and “how to use.” Various methods not only help students fully understand the concept of law, but also cultivate students’ attention to the reality and pay attention to the good thinking habits of law application.
