法在中国历史悠久,有其特殊含义。法作为司法判决依据的一种,在古代司法判决中占有一定的地位。本文拟以《名公书判清明集》中的违法交易为例,探讨法在古代司法判决中享有怎样的地位,以及古代司法官在判决时运用法的方式对我国现代司法审判有何启示。
Law in China has a long history and has its special meaning. Law as a basis for judiciary judgments, in ancient judgments in the judgments occupy a certain position. This article intends to use the case of “Illegal transactions in the Ming and Qing Dynasties” as an example to explore the status of the law in the ancient judiciary and how the ancient judicial judge applied the method to the judgment of modern China.
