随着价格竞争在我国市场经济企业竞争中地位的加强,价格歧视在企业营销实践中的运用日益增多,不法价格歧视行为也日益增多,我国有必要加强对价格歧视的相关立法工作。我国现有的《价格法》与《制止价格垄断行为暂行规定》相关价格歧视条款过于简单,价格歧视构成要件不明确,客体要件内涵宽泛,使得司法实践中难以操作。是加强价格歧视立法不可或缺的工作,本文通过比较分析,将价格歧视的客体要件界定为相同质量的商品,并将具有微小差异的商品及相同成本的商品及相同成本收益率的商品排除在外。
With the price competition in the market economy in our country’s competition in the strengthening of the position, the price discrimination in the business marketing practice is increasing, unscrupulous price discrimination is also increasing, our country needs to strengthen the relevant legislation on price discrimination. The existing price discrimination law in our country and the Provisional Regulations on Suppression of Price Monopolization are too simplistic in terms of price discrimination. The elements of price discrimination are not clear, and the connotation of the object elements is very broad, making it difficult to operate in judicial practice. Is to strengthen the legislation of price discrimination indispensable work.Through comparative analysis, this article defines the object of price discrimination as the same quality of goods, and will have a slight difference between the goods and the same cost of goods and goods with the same cost-yield excluded .
