交通肇事逃逸是指行为人在发生交通事故后,为逃避法律追究而逃跑的行为。在交通肇事犯罪中,车辆肇事后司机逃逸往往被认为是性质恶劣的情节。本文认为,将逃逸行为作为交通肇事罪的情节加重犯是合理的,“因逃逸致人死亡”不仅指行为人交通肇事后为逃避法律追究而逃跑,致使被害人因得不到救助而死亡,也包括行为人在第一次交通肇事后逃跑,在逃逸的过程中,发生第二次交通肇事事故致人死亡的情形。
Traffic Accident Escape refers to the behavior of people in a traffic accident, in order to evade legal prosecution and behavior.
