教育惩戒对维护学校的教育教学秩序和保障学生的受教育权利具有重要意义。鉴于残疾学生教育惩戒的复杂性和敏感性,美国联邦政府于1997年修订《残疾人教育法》时专门增加了残疾学生教育惩戒的法律条款。本文考察了美国残疾学生教育惩戒的目的、程序和实施原则,力图探明其法治原理,并对残疾学生教育惩戒存在的问题进行了反思。
Educational punishment plays an important role in maintaining the order of education and teaching in the school and guaranteeing the right to education of the students. In view of the complexity and sensitivity of education for disabled students, the federal government specifically revised the Disability Education Law in 1997 to increase the legal provisions for the punishment of disabled students. This article examines the purpose, procedure and implementation principles of disability education for disabled students in the United States, attempts to prove its principle of rule of law, and reflects on the existing problems of disability education.
