随着人类环境问题的日益加剧,环境与发展之间需要进行综合决策的这一观点得以成长。在法律的视野中,环境与发展综合决策具有复杂、多变的内涵。它的功能在于协调利益、平衡关系;它的需求来自于利益主体的多元化;它是一种以和谐的方式缓解或消除冲突的方法,同时它也是一个双向互动的过程。环境与发展综合决策的法律机制不仅与环境法密切相关,而且还与各个部门法晴雨相连。
With the worsening of the human environment, the view that comprehensive decision-making is needed between environment and development has been developed. In the legal field of vision, comprehensive decision-making on environment and development has a complex and ever-changing connotation. Its function is to coordinate interests and balance relations; its needs come from the diversity of stakeholders; it is a way to ease or eliminate conflicts in a harmonious way and at the same time it is also a two-way interactive process. The legal mechanism for comprehensive decision-making on environment and development is not only closely related to environmental law, but also linked to the rainstorm of various departments.
