引言当下,改革证据制度及制定证据法典(规则)是理论界和实务界研究的热点课题。为此,学习和借鉴国外证据制度中行之有效的经验,目前也应是学者们的一项重要的研究工作。本文拟在介绍德国审前证据调查程序的基础上,对完善我国民事诉讼证据制度提出一些建议,为同行们的研究提供一份比较法上的参考资料。
Introduction Nowadays, the reform of the evidence system and the development of the code of evidence (rules) are the hot topics of theoretical and practical research. For this reason, learning and drawing lessons from the evidence in foreign evidence system should also be an important research work of scholars at present. Based on the introduction of the German pretrial evidence investigation procedure, this article proposes some suggestions for perfecting the evidence system of civil procedure in our country and provides a comparative reference material for the peer research.
