经济审判工作要为《企业法》实施服务,不可不注意当前企业在贯彻《企业法》方面有哪些阻力?我们认为,这些阻力主要包括:一、厂长(经理)负责制在一部分企业真正落实难;二、有的企业见利忘义,热中于非法经营;三、某些企业经营管理习惯于无章无制;四、有的主管部门对企业的干预不愿松手;五、企业某些合法权益受到侵犯;六.向企业摊派人力、物力、财力的歪风禁而不止;七、某些管理部门法律意识薄弱;八、企业间的往来、联营、合作关系和企业内部的承包、租赁形式,都未真正走上法制轨道。经济审判工作应针对这些问题,作出自己的部署。我们认为,当前经济审判工作,应主要把握好如下七个方面的问题:
