云南傣族传统法律受佛教影响是较为全面的,具体体现在:立法上有立法思想、原则、技术和表达方式等方面;在实体内容上表现在刑事法律、民事法律和行政法律等方面;在司法上表现在审判的原则、证据的构成、判决形式等,甚至是人们对待法律的态度等。云南傣族法律在吸收佛教相关内容上与我国西藏地区和中世纪欧洲教会法的差别是较为明显的,因为它是一种非完全受佛教僧侣控制政权组织或非二元对立下的法律与宗教的关系。认真分析,它是人类法律与宗教三种基本关系中的一种,即以保持世俗法律为主下有机吸收宗教因素的法律与宗教的关系。
The traditional Dai nationality in Yunnan is influenced by Buddhism in a more comprehensive manner. It includes the following aspects: legislative thoughts, principles, techniques and ways of expression in legislative aspects; criminal law, civil law and administrative law in terms of substantive content; On the performance of the principle of trial, the formation of evidence, the form of judgment, and even people’s attitude toward the law. The difference between Yunnan’s Dai law and the Tibetan law in our country and the European Church Law in the Middle Ages is more obvious because it is a legal and religious relationship that is not completely controlled by a Buddhist monk or a non-binary opposition . Seriously analyzing it, it is one of the three basic relations between human law and religion, that is, the relationship between law and religion that organically absorbs religious elements under the protection of secular laws.
