在理清航班延误概念的基础上,指出航班延误的法律性质属于民航运输合同的违约行为。根据华沙公约及我国民航法的规定,承运人对航班延误应承担法律责任,除非承运人证明其“已经采取一切必要措施,或者不可能采取此种措施”。我国《民用航空法》采用华沙公约的措辞表述航班延误责任的承担及其免责,采用过错推定的归责原则,其与我国《合同法》违约责任的归责原则并不矛盾;在责任承担方式上主要是继续履行、采取补救措施、支付违约金和赔偿损失,当延误是因为天气原因、空中管制原因、机场部分原因及突发机械故障等不可抗力事由造成的,承运人免除责任。
On the basis of clarifying the concept of flight delay, it is pointed out that the legal nature of flight delay belongs to the breach of contract of civil aviation contract. According to the provisions of the Warsaw Pact and China’s Civil Aviation Law, the carrier shall bear the legal responsibility for the delay of the flight unless the carrier proves that it has “taken all necessary measures or is impossible to take such measures.” China Civil Aviation Law adopts the wording of the Warsaw Pact to describe the assumption of responsibility for flight delays and its exemption and adopts the principle of imputation of fault presumption, which is not contradictory to the principle of imputation of the liability for breach of contract in China’s contract law. Mainly to continue to perform, to take remedial measures to pay liquidated damages and compensation for damages, when the delay is due to weather, air control reasons, some airport causes and sudden mechanical failure caused by force majeure, the carrier exempt from liability.
