民商法是一项与社会生活与各行业生产密切相关的重要法律规范,它是市场经济本质要求以及内在规律的体现。我国社会主义市场经济以民商法为关键的法律秩序基础,而随着当前经济的不断发展,诚信实用原则在维护市场经济高效、合理、有序运行过程中逐渐受到人们的关注和重视,并将这一原则纳入民商法范畴之中。基于此,笔者对诚实信用原则在民商法体系中应用问题与缺陷进行分析,探讨了相应的完善策略,希望有所指导和帮助。
Civil and Commercial Law is an important legal norms closely related to social life and the production of various industries. It is the embodiment of the essential requirements of the market economy and the inherent law. With the continuous development of the current economy, the principle of honesty and trust has gradually drawn the attention and emphasis of the people in the process of maintaining the efficient, rational and orderly operation of the market economy. The This principle is included in the category of civil and commercial law. Based on this, the author analyzes the application problems and defects of the principle of good faith in civil and commercial law system, discusses the corresponding improvement strategies, and hopes that it will provide some guidance and help.
