纠纷解决这个概念具有目的性、过程性和结果状态三个层次上的含义,它们既相互联系又互相独立。目的性决定了纠纷解决的基本方向,过程性具体表现为纠纷解决的各种方法和手段的运行过程,结果状态则反映了纠纷解决的程度、判断标准和实际效果。在这样的前提下去研究纠纷解决的意义、方式和标准,才能对纠纷解决及其外围概念作出合乎逻辑的理性判断。
The concept of dispute resolution has the three levels of meaning of purpose, process and result. They are interrelated and independent. The purpose determines the basic direction of dispute resolution, and the procedural performance is the operation process of various methods and means of dispute resolution. The result status reflects the degree of dispute resolution, judgment standard and actual effect. Under the premise of studying the meaning, methods and standards of dispute resolution, we can make a logical and rational judgment on dispute resolution and its peripheral concepts.
