有别于其他民事争议处理程序,劳动争议案件采用“一裁两审”制,申请劳动仲裁是劳动案件诉诸法律解决的必经前置程序。劳动争议处理程序繁复,耗费时间长,劳动者维权成本高等声音一直以来不绝于耳。2008年5月1日施行的《劳动争议调解仲裁法》中规定的部分案件实行“一裁终局”制度,正是立法者基于上述现实状况而作出的考量。可是只需经“一裁”真的如此轻松地解决问题了吗?“一裁终局”制度在执行中会遇到怎样的尴尬?请看——
