6月5日,最高人民法院召开新闻发布会,向社会通报《最高人民法院关于审理买卖合同纠纷案件适用法律问题的解释》的有关情况。历年民商事纠纷案件中,买卖合同纠纷案件数量一直相当庞大。司法统计数据显示:2009年全国各级人民法院共新收一审买卖合同纠纷案件591425件,审结594404件;2010年全国各级人民法院共新收一审买卖合同纠纷案件551395件,审结555553件;2011年全国各级人民法院共新收一审买卖合同纠纷案件533401件,审结526367件。司法实践中,合同法中关于买卖合同的46个条文,难以涵盖买卖合同关系的复杂性和多样性以及市场交易日新月异的
