基于民法学视角下,情谊行为与民事法律行为的差异属于一个民法价值判断问题,在价值判断结果不同的情况下,民事法律形式在情谊行为当中的适用价值也有所不同。本文在分析情谊行为与民事法律行为差异的意义的基础上,进一步对情谊行为与民事法律行为的差异性进行论述,希望以此更加深入了解情谊行为与民事法律行为之间的差异性。
Based on the perspective of civil law, the difference between the behavior of affection and the behavior of civil law belongs to the problem of judging the value of civil law. In the case of different judgment of value, the value of civil law in the act of affection is different. Based on the analysis of the significance of the difference between the behavior of friendship and the behavior of civil law, this paper further discusses the difference between the behavior of friendship and the behavior of civil law, and hopes to deepen the understanding of the difference between the behavior of friendship and the behavior of civil law.
