在著作权领域,任何作品的创作都是要建立在前人的作品之上的,因此,在作品的创作过程中,对于借鉴的程度在合理限度内是不构成对著作权的侵害的。但是,一旦借鉴达到一定程度,就可能构成侵害对原作者著作权,成为侵权演绎作品,而这类作品是否享有著作权保护,始终是充满争议的问题,本文将通过分析琼瑶诉于正侵害著作权案来讨论侵权演绎作品的著作权保护问题。
