普通高中“三限”政策的出台与世纪末的择校乱象联系在一起,政府在教育市场化改革中秉持的利己和融资心态使得本来不合理的收费合法化。但合法化并不代表就拥有了合法性。通过对“三限”政策合法性审查和执行效果评估发现,其本身存在的合法性令人质疑,其在效益标准、效率标准、公平标准和政策回应度等方面均不能达到良好的政策目的。因此,在当今注重公平、倡导和谐的社会大背景下,普通高中“三限”政策理应退出历史的舞台,被新的更为科学、合理、公平的政策所取代。
The promulgation of the policy of “ordinary high school” and “three limits” by the senior high schools is linked with the phenomenon of school choice and chaos by the end of the century. The egoism and financing mentality that the government upholds in market-oriented education reforms have legitimized the originally irrational fees. But legalization does not mean that it has legitimacy. By examining the legality of the “three limits” policy and evaluating the effectiveness of its implementation, it is found that the legitimacy of its own existence is questionable and it can not achieve good policies in terms of efficiency standards, efficiency standards, fair standards and policy responses purpose. Therefore, under the current social background of fairness and advocacy of harmony, the policy of “three limits” of the ordinary senior high schools should be withdrawn from the stage of history and be replaced by a new, more scientific, rational and fair policy.
