末位淘汰制度起源于西方的用人单位管理,自出现以来被许多企业的管理者所应用,虽然曾经取得了显著效果,但是在实际的操作过程中却暴露出了许多弊端。本文以现代劳动立法为研究背景,在评述末位淘汰制度的基础上,尝试从多角度、多层面深入剖析末位淘汰制度的现实价值以及法律上存在的漏洞,为末位淘汰制度下劳动者自身权益的维护提出相应的方法与策略。
