对垄断行为的警觉与处罚,一直是现代市场经济国家为维护公正的市场秩序所采取的必不可少的国家行动。之所以国家行动必不可少,因为垄断行为直接侵蚀市场经济的平等原则,对市场经济的正常发展产生非常严重的影响;之所以是国家行动,因为垄断现象的存在已经不能再依靠单个的市场个体的力量与之抗衡。2011年末,国家发改委价格监督检查与反垄断局所做的一系列反垄断调查,不仅是代表了中小市场个体的声音,更是展现了国家对垄断行为的一种姿态。
The vigilance and punishment of monopolistic behavior have always been the indispensable national action taken by modern market-economy countries in safeguarding a fair market order. The reason why state action is indispensable is that monopoly behavior directly erodes the principle of equality in the market economy and has a very serious impact on the normal development of the market economy. The reason for this is that the state action is conducted because the monopoly phenomenon can no longer rely on individual market entities The power to compete with it. At the end of 2011, a series of antitrust investigations conducted by the NDRC’s Price Surveillance and Anti-monopoly Bureau not only represented the voices of individuals in small and medium-sized markets, but also demonstrated the state’s stance on monopolistic behavior.
