拖欠工资是近年来我国劳动领域中的一个突出问题,它不仅是一种违约行为,更是一种严重违反劳动行政管理秩序的、具有严重社会危害性的、严重影响劳动关系和谐稳定的违法犯罪行为。因而对工资拖欠法律责任的研究,是有效遏制工资拖欠行为、完善工资立法的有益探讨。本文从工资与工资权的关系出发,剖析了工资拖欠行为的法律属性,进而从社会法的视角提出了工资拖欠的三重责任。最后结合总理讨薪案,对我国工资法律制度进行了反思,并提出具有建设性的完善建议。
It is not only a breach of contract, but also a serious social harm that seriously violates the labor administration and management order, which seriously affects the harmonious and stable labor relations behavior. Therefore, the research on the legal liability of wage arrears is a useful discussion to effectively curb wage default behavior and improve wage legislation. Based on the relationship between salary and wage right, this article analyzes the legal attributes of wage default behavior, and then puts forward the triple responsibility of wage default from the perspective of social law. Finally, combining with the case of the prime minister, we reconsidered the legal system of wages in our country and put forward constructive suggestions.
