行业组织在我国是发展最快、最具代表性的一类社会中介组织。但是,关于行业组织的性质和地位,却一直得不到准确的定性。行业组织是否是行政主体?何种情况下由行政法进行调整?

行业组织在我国是发展最快、最具代表性的一类社会中介组织。但是,关于行业组织的性质和地位,却一直得不到准确的定性。行业组织是否是行政主体?何种情况下由行政法进行调整?这些问题不仅影响到行业组织功能的发挥,更重要的是,将影响社会公众的合法权益。本文即试图就这一问题略陈管见。
Industry organizations in our country are the fastest growing and most representative types of social intermediary organizations. However, the nature and status of trade organizations have not been accurately characterized. Whether the industrial organization is the administrative body and under what circumstances are the administrative law adjusted? These problems not only affect the function of the industrial organization, but more importantly, they will affect the legitimate rights and interests of the public. This article is an attempt to make mistakes on this issue.
