法案征求民意是我国宪政架构的必然要求,是主权代表者就法案征求主权者同意、发现主权者真意的工作机制。网络技术的发展为法案征求民意提供了简便、快捷的工具,大大降低了法案征求民意的成本,导致法案在网络征求民意的兴起。法案网络征求民意的兴起一方面满足了我国民主立法的要求,另一方面也给我国法律、法规体系带来挑战,出现了法案起草者征求民意的实践。法律制定者就法案征求民意具有合理性,而起草机关由于缺乏法案重要与否的政治判断能力,没有通过法律的权威,不能成为法案征求民意的机关。同时,法案征求民意是主权代表者与主权者沟通的机制,必须认真对待法案民意,发现主权者的真意,回应民众的意见。此外,法案征求民意需畅通表达的渠道,使每个公民都有提出意见的机会,必须防止以网络征求民意代替其他征求民意的方式的危险,网络毕竟只是征求民意的途径之一。
