行政越权在法律上被视为一种严重的行政违法行为,现有研究往往从导致行政越权体制方面的、观念方面的以及现实利益方面的原因寻求解决越权的办法。本文在研究过程中首先从概念上对行政越权以及相关概念作了界定,然后对行政越权的构成要件进行了简要的分析,在此基础上对行政越权的法律后果及救济途径做了详细的论述,在论文的最后,从权力的来源、运行及运行结果几个环节上加强对行政权的监督和控制,提出了防止行政超越职权的对策,希望这对于解决行政越权,促进行政机关依法行政具有现实意义。 Administrative overreach is legally regarded as a serious administrative law-breaking act. The existing researches tend to seek solutions to ultra vires from the aspects of conception and reality that lead to administrative overreaction. In the process of research, this article first defines the concept of administrative overreach and related concepts, and then makes a brief analysis of the constitutional elements of administrative overreaching. Based on this, it gives a detailed discussion of the legal consequences and remedies of administrative overreaching , At the end of the thesis, we strengthen the supervision and control over the executive power from several aspects such as the source, operation and operation results of the power, put forward the countermeasures to prevent the administrative from exceeding the authority, and hope that this is of great significance in solving the problem of overreaching administrative authority and promoting the administration according to law Realistic meaning.
