行政法教学实践中存在案例教学的方法、案例的采集、案例教学难点、授课形式等一系列问题。行政法案例教学方法有两种,即“以案释法”和纯粹针对案例进行分析。案例的采集,应该取正在发生的、尚没有定论的行政案例。案例教学的难点在于案例教学投入成本巨大;对学生系统性讲授和方法性培养之间存在矛盾;因材施教的问题;角色转换问题;开放性案例是否应明确结合的问题。授课的形式,应该采取小班制,注重讨论与师生之间的互动。
In the practice of teaching in administrative law, there are a series of problems such as the method of case teaching, the collection of cases, the difficulty of teaching cases and the teaching forms. There are two teaching methods of administrative law cases, that is, “case-based interpretation” and purely case-based analysis. Case collection, should take what is happening, there is no conclusive administrative case. The difficulty of case teaching lies in the huge cost of case teaching; the contradiction between systematic teaching and methodological training of students; the problem of teaching students according to their aptitude; the question of role conversion; whether the open case should be clearly combined. The form of teaching, should adopt a small class, focusing on the interaction with teachers and students.
