物权变动是物权立法政策和立法技术上的重大课题。物权变动与其原因行为的区分原则,就是把因合同所生的债权变动的法律效力与因物权独立意思表示加以确定并以登记交付为标志所生的物权变动的效力区分开来的原则。该原则彻底理清了物权变动的原因(债权的变动)与结果(物权的变动)之间的关系。
