赦免权是一个由来已久的话题,存在于古今中外的法律制度之中。赦免在最初是一种由君王行使,用以彰显皇恩的恩赐制度,是君权的重要组成部分。随着时间的推演,近现代意义上的赦免作为一种国家权力,通常是由国家元首或最高国家机关以政令或者法案的方式颁布的免除或者减轻犯罪人罪刑的法律制度,多由宪法或者宪法性法律进行规范。然而无论是在理论研究中,还是在实际操作层面上,赦免权都处于一个十分尴尬的境地。在法学理论研究中,宪法学、刑法学,都在有意无意的忽视对赦免权的研究,本文仅就赦免的含义以及法律上的规定性加以简单的介绍分析。
