侦查活动的立法规制是完善法制和保障人权的需要,也是提高刑事诉讼效率的重要路径。我国应以惩治犯罪的现实需要以及政治、经济、社会的条件为前提,借鉴国外技术侦查的立法规制的实体性、程序性规定,从适用范围、批准程序以及权利救济等方面完善我国的技术侦查法律制度,从而提高其在刑事侦查活动中的效用。
The legislative regulation of investigation activities is the need of perfecting the legal system and safeguarding human rights. It is also an important way to improve the efficiency of criminal procedure. China should improve the technical investigation of our country from the aspects of scope of application, approval procedure and right relief by using the actual needs of punishing crime and the conditions of politics, economy and society as the precondition, learning from the substantive and procedural rules of legislative regulation of foreign technology investigation Legal system, thereby enhancing its effectiveness in criminal investigation activities.
