【裁判摘要】生产者在商品包装上标明的实际产地,虽然与相同或者类似商品的注册商标中含有的地名相同,但不会造成消费者对商品的混淆、误认的,属于《中华人民共和国商标法实施条例》第四十九条规定的正当使用。
【Referee Summary】 Although the actual place of origin marked on the package by the producer is the same as the place name contained in the registered mark of the same or similar article, it will not cause confusion or misidentification of the consumer on the goods, and belongs to the "People's Republic of China Proper application of Article 49 of the Implementing Regulations of the Trademark Law.
