“依法行政”与行使自由裁量权同时存在于行政执法活动之中。把握好它们的关系,对于提高执法效率、保护当事人的合法权益、并在执法实践中正确运用自由裁量权、减少行政复议和行政诉讼的发生具有十分重要的意义。
“Administration according to Law” and Exercise of Discretion Exist in Administrative Enforcement Activities. Grasping their relations is of great significance for improving the efficiency of law enforcement, protecting the legitimate rights and interests of the parties concerned, and correctly using discretion in law enforcement practice to reduce the number of administrative reconsideration and administrative litigation.
