我国社会当前相当一部分犯罪是由社会冲突引发的。这种剧烈的社会冲突主要不是政治冲突,而是经济利益冲突。我国正处于社会转型期,新旧观念交织,公民社会、理性社会尚未形成。因此,解决社会冲突的方式,尤其是治理犯罪,不能仅仅依赖刑事手段,应采取务实、多样化策略和技术,并逐步过渡到高水平的法治规则解决方式,即主要通过民主协商的方式予以解决。
At present, a considerable part of the crimes in our society are triggered by social conflicts. This violent social conflict is not primarily a political one but a conflict of economic interest. Our country is in a period of social transition and the old and new concepts are intertwined. Civil society and rational society have not yet formed. Therefore, the solution to social conflicts, especially crime control, can not rely solely on criminal measures. Pragmatic and diversified strategies and technologies should be adopted and the solution to the high-level rule of law rules should be gradually adopted, which is mainly solved through democratic consultation .
