协同创新是中国创新体系的重要组成部分,既要求产学研联盟各主体深度合作和资源共享,也增加了知识产权的权属纠纷和开发风险,其中知识产权利益分配冲突是合作各方关注的焦点,构建科学合理的利益分享法律制度是产学研合作联盟长期稳定发展的基础,英国校企间合作的《兰伯特协议范本》为我国提供了示范和借鉴。我国需要建立以独有知识产权为中心、权利合理运用和分享的法律制度,以平衡大学和企业对知识产权成果拥有和运用的权利并保障产学研联盟各主体的利益平衡和合作共赢。
Collaborative innovation is an important part of China’s innovation system. It not only requires deep cooperation and sharing of resources among all main bodies of industry, university and research institutes, but also increases ownership disputes and development risks of intellectual property rights. The conflict of interest distribution of intellectual property rights is the focus of attention of all parties involved in the cooperation The establishment of a scientific and reasonable legal system for the benefit-sharing is the basis for the long-term stable development of the industry-university-research cooperation alliance. The “Lambert Agreement Model” for cooperation between schools and enterprises in Britain provides a model for our country. China needs to establish a legal system that uses proprietary intellectual property rights as its center and uses and shares its rights rationally to balance the rights of universities and enterprises in owning and using intellectual property achievements and to safeguard the interests of all parties in the industry-university-research alliance.
