TRIPs作为知识产权保护领域里水平较高、涉及面较广的一个国际公约,在驰名商标的反淡化保护上提供了跨类保护,为各国对反淡化保护从国际法的层面上提供了原则性的框架。在TRIPs的原则指导下,各国在立法和司法实践中发展了一些对驰名商标反淡化保护的一些机制,推动了各国在立法和司法实践的发展,使各国在驰名商标的保护上观念趋于统一,保护措施相互协调。
