技术是无形的知识形态的商品。技术权益是指当事人依法对技术成果享有精神权利和经济权利的总和。根据我国现行法律,技术权益属知识产权。由于目前我国社会主义市场经济体制还正在建立的过程之中,企业科技人才的流动尽管带来了技术成果的转化,创造了极大的社会效益,但另一方面也引发了诸多的技术权益纠葛和矛盾。本文仅就这方面法律问题作一粗浅的探索。
Technology is an intangible commodity of knowledge. Technical rights and benefits refer to the sum total of the parties’ right to enjoy moral rights and economic rights over technological achievements. According to the current laws of our country, technical rights are intellectual property rights. As China’s socialist market economic system is still in the process of being established, the flow of scientific and technological talents of enterprises has brought about great social benefits despite the transformation of technological achievements, but on the other hand it has also caused a great deal of technical rights and interests. And contradictions. This article only makes a cursory exploration of legal issues in this area.
