自2007年最高人民法院收回了下放20余年之久的死刑复核权开始,确立了少杀慎杀的政策,在实际运用过程中体现了少杀慎杀原则的基本精神,保障了公民权的实施,推动了法治社会的建设。梳理近年来少杀慎杀政策在实际运用中的体现和困局,有利于人权事业的进一步发展,为法治社会的构建给予启示。
Since the Supreme People’s Court took back the right of reviewing the death penalty for more than 20 years since 2007, it has established a policy of avoiding killing and cautious killing.
