目前我国公立高校校长的选拔基本上参照党政领导干部的任免方式进行,在一定程度上制约了高校办学自主权的发展与落实。从法理上讲,《高等教育法》第40条的规定乃是一个委任性规定,并不必然指向《党政领导干部选拔任用工作条例》的适用,该条例并非强制适用于公立高校校长的任免程序。国外大学通常由章程规定校长任免方式和具体程序,且一般存在投票议决程序。在积极落实《国家中长期教育改革与发展纲要》、大力推进现代大学制度建设的情形下,高校校长任免应根据各校实际情况,在充分讨论、慎重决策的基础上对校长任免制度予以完善。同时,为避免产生过大的波动,可以先行试点改革。
