随着城市化进程的加快和公共设施的增加,农村集体土地的征收与补偿已不可避免,土地征收关系到国家、集体及个人的利益冲突和利益平衡,如果征地补偿制度不公平、不合理、不规范,征地不仅会造成财富的损失,还可能激化矛盾。鉴于目前集体土地征收制度存在诸多不足之处,通过对我国相关的法律法规探析,着重分析我国集体土地征收的条件、程序及征地补偿制度等问题,尤其在完善我国集体土地征收的基本构想方面,就“公共利益”范围的可行性思路提出见解。如何在现行法律制度下进一步完善我国农村集体土地征收与补偿制度,是我们迫切需要解决的一个重大问题。
With the acceleration of urbanization and the increase of public facilities, the requisition and compensation of rural collective land is inevitable. How to further improve China’s rural collective land expropriation and compensation system under the current legal system is an important issue that we urgently need to solve.
