行政相对人作为与行政主体相对应的一个行政法概念,已成为行政法学的一个基本范畴;但是,行政相对人作出的行政法意义上的行为,即相对行为问题,却是一个很少有人专门系统研究的问题。经济领域的相对行为,即经济相对行为问题理应成为行政法学研究的范畴之一。对经济相对行为若干基础问题进行初步探讨,对于完善经济行政法学乃至行政法学的理论体系具有重要意义,也有益于我国经济行政立法、执法和监督的法律实践。
As an administrative law concept, the administrative counterpart has become a basic category of administrative law. However, the administrative law-related act made by the administrative counterpart, that is, the relative behavior issue, is a very rare subject Systematic research questions. Relative behavior in the economic field, that is, the question of relative economic behavior, should become one of the areas of administrative law study.
