严格责任原则是英美法系国家中的一项特有的,重要的责任制度,与我国大陆法系的法律制度有很多冲突。然而,从经济发展的轨迹来看,采用严格责任对于缓解日益恶化的环境状况和日益增多的环境犯罪具有不可忽视的作用,它的产生有其必然性和合理性。我国在严重污染环境的犯罪中应借鉴英美刑法的严格责任。但是,为了减弱其不良影响,对严格责任的适用必须加以改进和限制,使之与中国法律制度相融合。
The principle of strict liability is a peculiar and important responsibility system in common law countries and has many conflicts with the legal system of civil law in China. However, judging from the track of economic development, adopting strict liability has a non-negligible effect on alleviating deteriorating environmental conditions and increasing environmental crime. Its occurrence has its inevitability and rationality. China should learn from the strict liability of Anglo-American criminal law in the crimes of serious environmental pollution. However, in order to lessen its adverse effects, the application of strict liability must be improved and limited so that it can be integrated with the Chinese legal system.
