2012年3月,全国人大审议通过了《全国人民代表大会关于修改<中华人民共和国刑事诉讼法>的决定。新刑事诉讼法贯彻了宽严相济形势政策,进一步强调保障当事人合法权利。在刑罚执行体制方面,完善了社区矫正制度,这对检察机关的社区矫正检察监督工作提出了新的要求。检察人员应当认真学习新刑事诉讼法的相关规定,准确理解这些条文规定的指导思想、立法宗旨,树立正确的检察监督理念。
In March 2012, the National People’s Congress examined and approved the Decision of the National People’s Congress on Amending the Criminal Procedure Law of the People’s Republic of China. The new Criminal Procedure Law has implemented the policy of strict and concustial conditions and further emphasized the protection of the legitimate rights of litigants. In terms of the penalty execution system, the community correction system has been perfected, which sets new requirements for procuratorial organs to supervise and prosecute the community. Procurators should conscientiously study the relevant provisions of the new Criminal Procedure Law, accurately understand the guiding ideology and legislative purposes stipulated in these provisions, and establish the correct concept of procuratorial supervision.
