《中华人民共和国民事诉讼法》已于今年4月14日起开始施行。新颁布的《民事诉讼法》与已同时废止的《民事诉讼法(试行)》比较,对银行、信用社影响最大的就是:银行、信用社贷款优先偿还的规定被取消了。在《民事诉讼法(试行)》第108条中,明确规定,企业法人破产倒闭后的债务清偿顺序的第三点为“国家银行和信用社贷款”。而在新的《民事诉讼法》的相关条款第204条中已无此规定,即国家银行、信用社已被看作一般的企业法人,等同于一般的民事主体了。
