司法权威是一种源自制度性的理性权威,是抽象层面的源于人们内心的精神层面的认同和敬畏。司法的公正性、程序的正当性才是司法权威来源中最核心、最具现实意义的、对司法权威影响最为直接、最受社会大众民意关注的方面。因此,在当下中国的语境下,树立司法权威的关键路径应当是建立正当程序,切实做到司法公正。
Judicial authority is a kind of rational authority originating from the system. It is the identity and awe from the inner spiritual level of the abstract level. The impartiality of the judiciary and the legitimacy of the procedure are the most central and most realistic meanings of the sources of judicial authority. They have the most direct impact on the judiciary authority and are most concerned by the public opinion. Therefore, in the current context of China, the key path to establishing judicial authority should be to establish due process and effectively achieve judicial fairness.
